LegalTerms of Service
These terms govern your use of VODPilot, a service operated by Michael Ketzer, including account access, billing, uploads, and related support.
Last updated: June 4, 2026
1. Acceptance of terms
By accessing or using VODPilot, you agree to these Terms of Service. If you use the service for a company, team, or creator business, you confirm that you are authorized to accept these terms on that party’s behalf. Mandatory consumer protection rights remain unaffected.
2. The service
VODPilot is a service operated by Michael Ketzer for running a 24/7 replay channel from your existing stream archive. The service may include account management, Twitch connection flows, review tools, VOD metadata handling, media storage, billing, and related support surfaces.
3. Accounts and access
- You are responsible for keeping your login methods and connected third-party accounts secure.
- You must provide accurate account and billing details and keep them current.
- You are responsible for all activity performed through your workspace unless caused by our own breach or misuse.
4. Acceptable use
- Do not use VODPilot for unlawful, abusive, exploitative, infringing, deceptive, harmful, or unsafe activity.
- Do not attempt to bypass rate limits, authentication, review controls, billing flows, or security protections.
- Do not interfere with VODPilot, our infrastructure, other users, Twitch, or any third-party service connected to VODPilot.
- Do not use VODPilot to evade enforcement, bans, account restrictions, legal orders, or platform rules on Twitch or any other service.
- Do not upload, store, process, schedule, or broadcast media unless you have the rights and permissions required to do so.
5. Prohibited content
- You must not upload, store, process, schedule, broadcast, link to, request, or promote child sexual abuse material, child exploitation, grooming, sexualized content involving minors, or any content that endangers minors.
- You must not upload, store, process, schedule, broadcast, link to, request, or promote non-consensual intimate imagery, sexual violence, human trafficking, coercion, extortion, stalking, or doxxing.
- You must not upload, store, process, schedule, broadcast, link to, request, or promote terrorist or violent extremist content, credible threats, instructions for serious violence, or content that incites or glorifies unlawful violence.
- You must not upload, store, process, schedule, broadcast, link to, request, or promote illegal hate speech, unlawful harassment, fraud, scams, malware, phishing, credential theft, unlawful sale of goods or services, or other illegal activity.
- You must not upload, store, process, schedule, broadcast, link to, request, or promote content that infringes copyright, trademark, privacy, publicity, trade secret, or other rights.
- You must not use VODPilot for content that violates Twitch rules, applicable platform policies, or laws in the places where you, your workspace members, viewers, VODPilot, or connected providers operate.
6. Your content and permissions
You keep your ownership rights in your media, metadata, branding, and other submitted material. You grant us a limited right to host, process, transmit, display, and transform that material only as needed to operate, secure, support, and improve VODPilot for your workspace.
7. Content review, enforcement, and reporting
- We are not required to pre-screen all content, but we may review, scan, hash, inspect, block, disable, remove, quarantine, or delete content and accounts when needed to operate the service, protect users or third parties, enforce these terms, investigate abuse, or comply with law.
- If we believe content or activity is illegal, dangerous, exploitative, infringing, or otherwise prohibited, we may immediately suspend processing, stop playout, disable access, preserve relevant information, notify affected providers, report to competent authorities or child-protection hotlines, and permanently ban the account or workspace.
- For suspected child sexual abuse material, child exploitation, serious threats, terrorism, or comparable urgent illegal activity, we will report to appropriate authorities, child-safety organizations, hotlines, or other competent bodies where required by law or where we believe reporting is necessary to protect people, third parties, or the public.
- We may cooperate with lawful requests, preservation requests, subpoenas, court orders, regulator requests, platform safety teams, and law-enforcement investigations.
- We may refuse to restore content or accounts that were removed for illegal activity, serious safety risk, rights infringement, payment fraud, or repeated policy violations.
8. Abuse reports and rights complaints
- If you believe VODPilot is being used for illegal content, exploitation, abuse, threats, copyright infringement, privacy violations, or other serious misuse, contact support@vodpilot.com with the workspace, URL, account, timestamp, and a short description of the issue where available.
- Reports should be made in good faith. False, abusive, or fraudulent reports may themselves violate these terms.
- When we receive a credible report, we may investigate, restrict access, ask for more information, notify the account owner where appropriate, remove or disable content, preserve evidence, or refer the matter to third parties or authorities.
9. Third-party services
VODPilot depends on third-party providers, including Twitch for account connections,
Paddle for payments, Neon for database infrastructure, Resend for transactional email, and Cloudflare R2 for object storage. Your use of connected third-party services may also be subject to their own terms and policies. Twitch permissions requested by VODPilot are shown during Twitch OAuth and summarized in the Privacy Policy. You can disconnect Twitch channels in settings; VODPilot then removes local channel tokens and related EventSub records unless logs or legal retention obligations require limited preservation.
10. Pricing, billing, and taxes
- The advertised VODPilot service pricing is €100 per creator workspace per month plus €16 per started TB of storage per month.
- Fees may be charged through Paddle as merchant of record.
- Recurring subscriptions renew automatically until canceled.
- Paddle shows the binding final payable amount, including any VAT/taxes Paddle is required to collect, before you place the order or approve an immediate storage update. Currency conversion and payment processor handling may affect the final amount charged.
11. Cancellations and refunds
You can cancel future renewals at any time through the
cancellation page or the Paddle customer portal. Unless required by law or stated otherwise in our separate refund policy, payments already charged are not automatically refunded. Statutory consumer withdrawal rights and mandatory consumer protection rights remain unaffected. Refund handling is described in the
Refund Policy.
12. Service changes and availability
We may update, improve, suspend, or discontinue parts of VODPilot from time to time. We do not guarantee uninterrupted availability and may perform maintenance, security changes, or emergency actions when needed.
13. Warranty disclaimer
VODPilot is provided with reasonable skill and care, but we do not guarantee uninterrupted availability, specific audience growth, uninterrupted Twitch availability, or compatibility with every third-party platform change. Statutory warranty rights, mandatory consumer rights, and liability that cannot legally be excluded remain unaffected.
14. Limitation of liability
Nothing in these terms limits liability for intent, gross negligence, injury to life, body, or health, guarantees, product-liability claims, fraudulently concealed defects, or other liability that cannot be limited by mandatory law. For simple negligence, we are liable only for breach of essential contractual duties and only for typical, foreseeable damage, unless mandatory law provides otherwise. For business customers, our aggregate liability for simple-negligence claims related to VODPilot is limited to the fees paid for the affected workspace during the 12 months before the event giving rise to the claim.
15. Termination
We may suspend or terminate access, stop processing, disable playout, delete content, or permanently ban an account or workspace if you breach these terms, upload or process prohibited content, create legal, safety, security, operational, reputational, or payment risk, fail to pay fees when due, or use VODPilot in a way that could harm us, users, third parties, Twitch, or connected providers. You may stop using the service at any time.
16. Illegal-content notices and DSA contact
Reports about illegal content, rights complaints, privacy violations, threats, minor-safety concerns, or serious misuse can be submitted through the
report form or by email to
support@vodpilot.com. Notices should include enough information to locate the reported content or activity, a reasoned explanation, contact details except where minor-safety law allows anonymity, and a good-faith statement. If a notice includes electronic contact details, VODPilot sends a receipt and later an update or decision where legally required or otherwise appropriate. VODPilot accepts notices in English and German. The same email address is the electronic contact point for users, authorities, and platform-safety escalation unless a different legally required channel is specified.
17. Business customer data processing
Where VODPilot processes personal data on behalf of a business customer, the
Data Processing Addendum applies to that processing unless a separately signed data processing agreement exists.
18. Consumer dispute resolution
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise.
19. Governing law
These terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules, unless mandatory consumer protection law provides otherwise.
